Guardianship

Legal guardianship is another option available to take care a child in absence of the parents. It allows parents to name a caregiver, who will have certain legal rights regarding the care of the child. In most cases, the parents maintain legal rights still play a role in their child’s life. Legal guardians have custody of the child and can make decisions about education, health, discipline, etc.

Guardianship could be a permanency option for a child, as it creates a legal bond between a child and caregiver, who can provide a permanent family for the child without necessarily terminating the parents’ rights. The child can be able to maintain connections with their parents, while having a stable and permanent home with a caregiver who has demonstrated a commitment for the child.

Guardianship can also be standby guardianship, when that the parent retains much of their authority over the child.
